1. Introduction & Acceptance

Welcome to SeasonalProperties.com (“Seasonal Properties”, “we”, “our”, or “us”). These Terms & Conditions (“Terms”) govern your use of our website and services. By accessing or using SeasonalProperties.com, you agree to be legally bound by these Terms. If you do not agree, you must not use the platform.

2. Nature of the Platform

Seasonal Properties is a digital marketplace and marketing platform that:

Showcases curated seasonal rental properties (30+ day stays)
Introduces property owners (“Owners”) and prospective renters (“Guests”)
Facilitates communication and potential lease arrangements

All agreements are strictly between Owner and Guest.

3. Eligibility

By using the platform, you confirm that you:

Are at least 18 years old
Have legal authority to enter binding agreements
Will provide accurate and truthful information

4. Listings & Property Information

4.1 Accuracy

Property listings are provided by Owners or their representatives. While we curate and review listings, we do not guarantee:

Accuracy
Completeness
Availability
Condition of the property

4.2 No Warranty

All listings are provided “as is” without warranties of any kind.

5. Bookings & Agreements

5.1 Direct Agreements

All bookings result in a direct agreement between Owner and Guest. Seasonal Properties:

Is not a party to the lease
Does not enforce lease terms
Is not responsible for disputes

5.2 Payments

Unless explicitly stated, payments are made directly between Guest and Owner.

6. Fees & Commissions

Seasonal Properties may charge:

Listing fees
Marketing fees
Commission fees to Owners

These are governed by separate agreements with Owners. Guests are not charged platform booking fees unless disclosed.

7. User Responsibilities

Guests agree to:

Conduct their own due diligence
Review lease terms carefully
Obtain appropriate insurance if desired

Owners agree to:

Provide accurate listing details
Comply with local laws, licensing, and tax requirements
Maintain property in safe, habitable condition

8. No Liability for Property or Stay

Seasonal Properties is not responsible for:

Property condition
Injuries or damages during a stay
Theft, loss, or personal harm
Misrepresentation by Owners or Guests

Use of any property is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, Seasonal Properties shall not be liable for:

Indirect or consequential damages
Loss of income, business, or opportunity
Travel disruptions or cancellations

Our total liability, if any, is limited to the amount paid directly to Seasonal Properties (if any).

10. Disputes Between Users

Any disputes arising between Owners and Guests must be resolved directly between those parties. We may:

Assist in communication (at our discretion)
Provide guidance

11. Cancellations & Refunds

All cancellation policies are determined by the Owner and defined in the lease agreement.

12. Insurance Disclaimer

We strongly recommend:

Guests obtain travel/renter insurance
Owners maintain appropriate property and liability insurance

Seasonal Properties does not provide insurance coverage for properties, guests, or transactions.

13. Intellectual Property

All content on SeasonalProperties.com—including branding, copy, images (excluding Owner-provided media), and platform design—is owned or licensed by Seasonal Properties and may not be used without permission.

14. Privacy

Your use of the platform is also governed by our Privacy Policy.

15. Termination

We reserve the right to remove listings, suspend users, or deny access at our sole discretion, without notice.

16. Governing Law

These Terms are governed by the laws of Province of Ontario, Canada. Any disputes shall be handled in Ontario courts.

17. Modifications

We may update these Terms at any time. Continued use of the platform constitutes acceptance of the updated Terms.

18. Properties for Sale

SeasonalProperties.com (“Seasonal Properties”) may provide a platform that allows property owners to advertise real estate properties that may be available for sale. These listings are provided for informational and marketing purposes only.

Seasonal Properties is not a real estate brokerage, real estate dealer, listing brokerage, buyer brokerage, mortgage brokerage, legal advisor, appraiser, home inspector, or financial advisor unless explicitly stated otherwise in writing.

By using the “Properties for Sale” section of the website, users acknowledge and agree to the following:

Direct Communication Between Parties. Buyers, prospective purchasers, renters, and property owners may communicate directly through the platform or via contact information voluntarily provided by the property owner. Seasonal Properties is not responsible for the content, accuracy, legality, or outcome of any communications, negotiations, agreements, or transactions between parties.
No Representation or Warranty. Seasonal Properties does not verify and makes no representations or warranties regarding:
- ownership of any property;
- accuracy of listing information;
- pricing, taxes, zoning, square footage, condition, permits, or legal status of a property;
- availability of the property;
- suitability for purchase, investment, rental, or occupancy.
All information is deemed reliable but is not guaranteed and should be independently verified by users.
Independent Due Diligence Required. Users are solely responsible for conducting their own due diligence before entering into any real estate transaction, including but not limited to:
- obtaining legal advice;
- verifying title and ownership;
- arranging inspections;
- confirming financing;
- reviewing zoning and municipal regulations;
- reviewing condominium, homeowner association, or community restrictions where applicable.
No Agency Relationship. Use of the platform does not create any agency, fiduciary, brokerage, partnership, employment, or representation relationship between Seasonal Properties and any buyer, seller, renter, or user of the website.
No Involvement in Transactions. Seasonal Properties is not a party to any purchase agreement, agreement of purchase and sale, lease, option agreement, financing arrangement, or other transaction between users unless separately contracted in writing.

Limitation of Liability. Seasonal Properties shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or financial damages arising from:
- reliance on listing information;
- property condition or defects;
- failed negotiations or transactions;
- disputes between buyers and sellers;
- fraud, misrepresentation, or omissions by any user or third party.
Right to Remove Listings. Seasonal Properties reserves the right, at its sole discretion and without notice, to remove, modify, suspend, or refuse any property listing for sale for any reason.
Compliance With Applicable Laws. Property owners and users are solely responsible for ensuring compliance with all applicable real estate, consumer protection, advertising, privacy, licensing, and competition laws in their jurisdiction.
No Guarantee of Sale or Purchase. Seasonal Properties does not guarantee that any property will be sold, purchased, rented, financed, or otherwise transacted through the platform.
MLS® and REALTOR® Disclaimer. Unless specifically identified otherwise, properties displayed on SeasonalProperties.com are not necessarily listed on MLS® systems and may not be represented by licensed real estate brokerages or REALTORS®. Any MLS® listings or brokerage relationships will be clearly identified where applicable.
Investment Disclaimer. Any references to rental income potential, investment opportunity, lifestyle value, appreciation, or market conditions are for general informational purposes only and do not constitute investment, financial, tax, or legal advice.
